These Terms are here to protect everyone: you, other Steerx users, and us. They explain:
• how the Steerx platform works,
• the rights and responsibilities of everyone using it,
• what we promise (and what we don't), and
• what happens if things go wrong.
We know "terms and conditions" aren't always fun to read. So we've tried to make these clear and straightforward, but they're still a legally binding agreement. By creating an account or using Steerx, you're agreeing to follow them.
In addition to these Terms of Use, certain activities on the Platform (such as driving services, subcontracting, or vehicle rentals) may be governed by separate service-specific agreements. Those agreements form part of your contract with us and apply alongside these Terms. In addition to these Terms, certain activities (like driving jobs, subcontracting, or vehicle rentals) have their own specific terms. If there's ever a conflict, those service-specific terms will take priority.
1. DEFINITIONS
In these Terms of Use ("Terms"), unless the context otherwise requires:
"Account" means a registered user profile created on the Platform.
"ACL" means the Australian Consumer Law set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth).
"Booking" means any accepted transaction on the Platform, including a job, subcontracting arrangement, or vehicle rental.
"Driver" means an individual registered on the Platform who provides transport or logistics services, including Primary Drivers and Subcontract Drivers.
"Fleet Company" means a business user that engages Drivers through the Platform.
"Platform" or "Services" means the Steerx website, mobile applications, and associated systems provided by Steerx Pty Ltd.
"Primary Driver" means a Driver who contracts directly with a Fleet Company for a job.
"User" means any individual or entity accessing or using the Platform, including Fleet Companies, Drivers, Vehicle Owners, and Vehicle Renters.
"Vehicle Owner" means a User who lists a vehicle on the Platform for rental.
"Vehicle Renter" means a User who hires a vehicle from a Vehicle Owner.
"We", "us", "our" means Steerx Pty Ltd (ABN [insert ABN]).
"You", "your" means a User of the Platform.
2. ACCEPTANCE OF TERMS
2.1 By creating an Account, accessing, or using the Platform, you agree to be bound by these Terms and our Privacy Policy.
2.2 If you do not agree with these Terms, you must not access or use the Platform.
2.3 Steerx may amend these Terms from time to time. Material changes will be notified by email or Platform notice. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
3. ROLE OF STEERX AND RELATIONSHIP OF THE PARTIES
3.1 While Steerx is not a party to user contracts, we will take reasonable steps to maintain the Platform, ensure accurate payment processing, and support dispute resolution between users in line with these Terms.
3.2 Steerx is not:
a) an employer of Drivers;
b) a transport operator;
c) a vehicle owner or lessor;
d) a party to any contract between Users.
3.3 Contracts for jobs, subcontracting, or vehicle rentals are entered into directly between Users.
3.4 Steerx is not responsible for the performance of Users.
3.5 Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between Steerx and any User.
4. ELIGIBILITY AND ACCOUNT REGISTRATION
4.1 You must be at least 18 years old and legally capable of entering into binding contracts.
4.2 You must provide accurate, current, and complete information when registering and keep your Account details up to date.
4.3 You are responsible for maintaining the confidentiality of your Account credentials and for all activity under your Account.
4.4 Steerx may suspend or terminate Accounts where verification requirements are not met.
5. VERIFICATION AND DOCUMENTATION REQUIREMENTS
5.1 All Users must undergo identity verification, including government-issued photo identification and proof of address.
5.2 Additional requirements apply depending on User type:
a) Drivers: hold and maintain a valid driver's licence appropriate to the class of vehicle you operate.
b) Fleet Companies: business registration, GST registration (if applicable), and commercial insurance.
c) Vehicle Owners: registration papers, insurance covering rentals, and vehicle condition documentation.
d) Vehicle Renters: valid licence and compliance with any insurance requirements.
5.3 Users must promptly provide documents requested by Steerx. Failure to do so may result in suspension or termination.
6. USER OBLIGATIONS
6.1 Fleet Companies
Fleet companies may post genuine job opportunities with accurate details of requirements, timing, payment terms, and qualifications. All postings must comply with Australian employment and anti-discrimination laws. Fleet companies must:
a) honour all representations made in postings, including pay and job specifications;
b) provide fair compensation and maintain appropriate insurance;
c) treat drivers lawfully, respectfully, and without creating unsafe conditions; and
d) comply with these Terms of Use and any applicable service-specific terms.
6.2 Drivers
(a) Must hold and maintain a valid driver's licence appropriate to the class of vehicle you operate and appropriate insurance that is required by law.
(b) Must perform jobs diligently and safely.
6.3 Vehicle Owners
a) Must ensure vehicles are roadworthy, insured, and accurately described.
b) Must provide vehicles in clean and safe condition.
6.4 Vehicle Renters
a) Must hold a valid driver's licence appropriate to the vehicle type.
b) Must use vehicles only as permitted by law and the rental agreement.
Are solely responsible for any loss of, or damage to, the vehicle during the rental period, subject to any insurance arrangements directly agreed with the Vehicle Owner.
7. TRANSACTIONS ON THE PLATFORM
7.1 Jobs
Acceptance of a job creates a contract between the Fleet Company and Driver, and ("Driver Engagement Contract").
7.2 Driver to Driver
a) A Driver may use the Platform to engage another Driver to assist with a Booking, provided the Fleet Company has not prohibited this.
b) Any such arrangement is a separate agreement between the Drivers.
c) The original Driver remains responsible to the Fleet Company for the Booking, even if another Driver assists.
7.3 Vehicle Sharing
(a) A rental agreement is formed directly between the Vehicle Owner and Vehicle Renter.
(b) Vehicle Owners must disclose any restrictions on use.
8. FEES, TAXES, AND GST
8.1 All service fees are clearly disclosed before you confirm any booking or transaction. By completing a transaction through the Platform, you agree to pay the applicable service fees. Service fees are automatically deducted from payments processed through the Platform and are generally non-refundable except as expressly provided in these Terms or required by law.
8.2 We use third-party payment processors to handle financial transactions securely. By using the Services, you authorize Steerx and our payment processors to charge your selected payment method for any amounts due, including service fees, rental payments, job payments, and any other charges that arise from your use of the Platform.
8.3 Users are responsible for their own tax obligations, including GST where applicable.
8.4 Where required by law, Steerx may report transactions to the ATO.
9. REFUNDS AND CANCELLATIONS
9.1 Refunds are subject to our cancellation and refund policies, which may vary depending on the type of transaction and timing of cancellation. Generally, cancellations made with at least 24 hours advance notice may be eligible for full or partial refunds, while late cancellations may result in cancellation fees or forfeiture of payments. For job cancellations, specific cancellation windows and fee structures apply depending on how far in advance the cancellation occurs. For vehicle rental cancellations, refund eligibility depends on the cancellation policy selected by the vehicle owner and the timing of cancellation.
9.2 Disputed charges will be reviewed according to our dispute resolution process.
9.3 In cases where services are not provided as agreed, where safety issues arise, or where other material breaches occur, affected parties may be eligible for refunds subject to investigation and verification.
9.4 Steerx reserves the right to determine refund eligibility based on the specific circumstances of each situation.
Nothing in this clause limits your rights under the Australian Consumer Law to a refund or remedy where services are not delivered as promised, are defective, or otherwise fail to meet consumer guarantees.
10. INSURANCE REQUIREMENTS
10.1 Steerx does not provide insurance for User activities.
10.2 Drivers, Fleet Companies, and Vehicle Owners must at their own cost, maintain adequate insurance appropriate to their activities on the Platform.
10.3 Users must not misrepresent insurance coverage.
10.4 Steerx may request proof of insurance at any time.
Users acknowledge that Steerx is not liable for any loss, damage, or claim arising from a User's failure to hold appropriate insurance.
11. COMPLIANCE WITH LAWS
11.1 Users must comply with all applicable laws and regulations in connection with their use of the Platform, including (where relevant):
a) Heavy Vehicle National Law (HVNL) and Chain of Responsibility;
b) workplace health and safety obligations;
c) tax, superannuation, and reporting obligations (including the ATO Sharing Economy Reporting Regime);
d) labour hire licensing (where required).
11.2 Steerx will comply with its own legal obligations as a platform operator, including under privacy, consumer, and tax laws.
12. USER CONDUCT
12.1 You may use the Services to find legitimate work opportunities, offer your services as a driver or fleet company, hire qualified subcontract drivers for assistance, communicate with other users regarding jobs and services through Platform messaging, process payments for completed work or vehicle rentals through our secure payment system, list vehicles for rental to other users, rent vehicles from other users for lawful purposes, and access customer support services when needed.
12.2 You agree not to use the Services to engage in any of the following prohibited activities. Violation of these prohibitions may result in immediate account suspension or termination:
a) provide false or misleading information about yourself, your qualifications, vehicles, business, or services.
b) You must not post fake reviews, manipulate ratings, or engage in any deceptive practices.
c) harass or discriminate against other Users;
d) attempt to circumvent Platform fees;
e) use vehicles for illegal purposes;
f) interfere with Platform security or integrity.
13. SAFETY OBLIGATIONS
13.1 Users must prioritise safety and report incidents immediately.
13.2 Drivers must not operate vehicles under the influence of alcohol, drugs, or while fatigued.
13.3 Vehicle Owners must maintain vehicles in a safe and roadworthy condition.
14. INTELLECTUAL PROPERTY
14.1 Steerx owns all intellectual property in the Platform.
14.2 Users retain ownership of their own content but grant Steerx a licence to use it for Platform purposes.
15. PRIVACY AND DATA PROTECTION
15.1 Steerx collects, stores, and processes personal information in accordance with its Privacy Policy and the Privacy Act 1988 (Cth).
15.2 Users consent to necessary sharing of information for transactions, verification, and compliance.
16. DISCLAIMERS AND LIMITATION OF LIABILITY
16.1 To the maximum extent permitted by law, Steerx provides the Platform "as is" without warranties.
16.2 Steerx is not responsible for:
(a) the acts or omissions of Users;
(b) the quality of services or condition of vehicles;
(c) accidents, injuries, or losses arising from transactions.
16.3 Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that you may have under the Competition and Consumer Act 2010 (Cth) (including the Australian Consumer Law) or any other applicable legislation that cannot be excluded, restricted or modified by agreement.
Where our liability under the ACL cannot be excluded, and to the extent permitted by law, our liability is limited (at our option) to:
1. supplying the services again; or
2. paying the cost of having the services supplied again.
16.4 In any event, Steerx's aggregate liability shall not exceed the greater of AUD $300 or the service fees paid by you in the 12 months preceding the claim.
17. INDEMNITIES
You indemnify Steerx against all claims, damages, losses, and expenses arising from:
a) your use of the Platform;
b) your breach of these Terms or applicable laws;
c) your misrepresentation of insurance or qualifications;
d) accidents, property damage, or injuries related to your activities.
18. DISPUTE RESOLUTION
18.1 If you have a dispute with another user or a complaint about the Services, you should first attempt to resolve the matter directly with the other party. We encourage users to communicate openly and professionally to resolve issues when they arise.
18.2 If unsuccessful, disputes may be submitted through the Platform's resolution process.
18.3 Steerx may hold disputed payments pending resolution.
18.4 These Terms are governed by the laws of New South Wales, Australia. Parties submit to the exclusive jurisdiction of its courts.
19. SUSPENSION AND TERMINATION
Steerx may suspend or terminate your account and your access to the Services immediately and without prior notice if:
a) You violate these Terms, our Privacy Policy, or any other applicable Platform policies;
b) You engage in fraudulent activity, including providing false information, payment fraud, or identity fraud;
c) You pose a safety risk to other users based on your conduct, driving record, or other factors;
d) You repeatedly receive poor ratings or negative reviews indicating substandard service or conduct;
e) You fail to maintain required qualifications, licenses, insurance, or documentation;
f) You violate insurance requirements or misrepresent your insurance status;
g) You engage in discriminatory, harassing, threatening, or abusive behavior toward other users;
h) You attempt to circumvent Platform fees or engage in off-platform transactions to avoid charges;
i) You create multiple accounts or attempt to circumvent account restrictions;
j) You interfere with Platform operations or attempt to gain unauthorized access to systems;
k) Your account has been inactive for an extended period and cannot be verified;
l) We are required to terminate your account to comply with legal obligations.
We will give you reasonable notice before suspension or termination where practicable, unless immediate action is required (e.g., fraud, safety risk, or legal requirement). You may also request a review of any suspension or termination decision.
20. RATINGS AND REVIEWS
20.1 Users may rate and review each other after transactions.
20.2 Reviews must be honest and not defamatory.
20.3 Steerx may remove reviews that breach policies.
21. CHANGES TO PLATFORM
Steerx may modify or discontinue Platform features at any time. Notice will be provided for material changes.
22. GENERAL PROVISIONS
22.1 These Terms, together with our Privacy Policy and any additional agreements or policies referenced herein, constitute the entire agreement between you and Steerx regarding the Services. These Terms supersede all prior communications, proposals, agreements, understandings, or representations regarding the subject matter herein.
22.2 If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable, or if that is not possible, will be severed from these Terms. The remaining provisions will be interpreted to give effect to the parties' intentions as reflected in these Terms.
22.3 Neither party may not assign, transfer, or delegate your rights or obligations under these Terms without the other party's Steerx's prior written consent, unless is in connection with a merger, acquisition, corporate reorganization, or sale of assets. You will be notified of any significant business transfers that affect these Terms.
22.4 Steerx shall not be liable for any failure or delay in performance of its obligations under these Terms due to circumstances beyond our reasonable control. This includes but is not limited to acts of God, natural disasters including fires, floods, earthquakes, or storms, war, terrorism, or civil unrest, pandemics or public health emergencies, labor disputes or strikes, government actions or regulations, power outages or telecommunications failures, or other events or circumstances beyond Steerx's reasonable control.
22.5 During force majeure events, Steerx's obligations will be suspended for the duration of the event. We will make reasonable efforts to resume normal operations as soon as practicable.
